Attorney Daniel P. Faherty said his office sent the notice to the city on March 3 as required under Florida Statute 768.28. The claim is being brought on behalf of Paul Adam Wert IV, who was arrested on May 10, 2025, after finishing work at a CVS on South Ridgewood Avenue in Edgewater.

According to the report, body camera footage shows Rippeon threatening Wert with a Taser and a police dog while Wert was waiting for a Lyft ride home. Wert was charged with resisting an officer without violence, but prosecutors later declined to pursue the case. Rippeon subsequently resigned from the Edgewater Police Department.

The pre-suit notice alleges Wert suffered physical injuries, emotional distress, reputational harm, and loss of liberty. Faherty also said Wert engaged in self-harm while jailed and required emergency medical care. Under the statute, Edgewater has six months to investigate the claim and decide whether to settle before a lawsuit may proceed.

The notice says payment of $180,000 would resolve claims against the city, while broader federal claims could still be pursued if the matter is not settled.
